Waverly man charged with making threats

WAVERLY — A Waverly man who locked himself in his house earlier this month during a standoff with law-enforcement and was shot after brandishing firearms at law enforcement officers has been arraigned.
Franklin Phillips, 39, Waverly, was arraigned in Wood County Magistrate Court on Wednesday before Magistrate Jody Purkey on a charge of threats of terrorist acts and was held on $75,000 cash bond.
On Tuesday, June 6 units responded to a domestic altercation at 115 Waverly St. between a father and son, according to the criminal complaint filed by Deputy R.A. Waters.
While on the scene, officers learned Phillips had warrants out for his arrest. When officers went to arrest Phillips on the warrants, he brandished two firearms at officers.
“Franklin Phillips came out of the residence waving two handguns in the air, as well as down to his side,” the criminal complaint said. “Franklin Phillips held one of the firearms to his head as he held the other one down to his side.
“Phillips said he was going to kill himself. Officers yelled at Phillips to put the guns down multiple times.”
Phillips responded he wasn’t going to and went back into the house.
Officers tried to get him come out and established communication with him.
“Eventually, Phillips came out onto the porch with the firearm in a shoulder holster and was telling officers he ‘was not going to come out and they were going to have to come in and get him,'” the complaint said.
He threatened to commit suicide by cop.
“He told officers to get comfortable because it was going to be a long night,” the complaint said.
Phillips was eventually shot by officers with the Sheriff’s Department’s SWAT team when they made entry to the trailer and he sustained gunshots to the leg and torso, said Wood County Sheriff Rick Woodyard on Thursday.
“Mr. Phillips is now out of the hospital,” Woodyard said. “He was released (Wednesday) afternoon, arraigned and bond was set.”
He is also being held on warrants for worthless check, obstructing and disorderly conduct. He was also served with a domestic violence protective order.
Phillips is being held at the North Central Regional Jail.
