Vienna man facing charges after altercation at Jackson Park

VIENNA — A Vienna man was arrested Thursday evening after a fight in Jackson Memorial Park where a gun supposedly went off.
Vienna Police arrested Carson Elliott who was charged with five felony counts of wanton endangerment with a firearm in connection to this incident, according to a press release from the Vienna Police Department.
Vienna Police Chief Carl Powell said Elliott was 19 years old and had a Vienna address.
Wood County Magistrate Court records list his address as 4302 Sandalwood Place in Vienna.
On Thursday at around 8:50 p.m. officers from the Vienna Police Department responded to a report of gunshots at Jackson Park, the press release said. Upon arrival, both the suspect and the victims had already fled the scene.
“The investigation revealed that the suspect and victims had arranged to meet at Jackson Park for a physical altercation,” the press release said. “During the encounter, the suspect produced a handgun and struck two victims, causing injuries to their heads and faces.
“While striking one of the victims, a round was discharged from the firearm. All individuals involved then fled the area.”
Powell said police received calls from people who were at the part at the time.
Officers later located Elliott.
“During an interview, Elliott admitted to striking the victims with the handgun and that a round had been fired during the incident,” the press release said. “Investigators subsequently recovered the firearm, which Elliott had concealed following the altercation.”
Powell said no one was shot and any injuries were a result of the fight itself.
In the criminal complaint written by Detective R.S. Black for magistrate court, the incident took place at a picnic shelter at Jackson Park near the tennis/pickleball courts where Elliot was with five other individuals that the report described as “the victims in this case.”
Those subjects were interviewed and it was said Elliott initiated a fight with one of the other subjects and hit him in the head with the gun when the gun went off close to the head of the other subject. That person sustained swelling and a scratch.
Another subject tried to separate the two and ended up being struck with the handgun as well and sustained lacerations to his head and nose.
“(The five subjects) were all within close proximity to Elliott when he discharged the handgun creating a substantial risk of death or serious bodily injury,” the report said. “All parties stated they were in fear for their life and safety before and/or after the handgun was discharged.”
Elliott was arraigned and released on a $15,000 surety bond.
Powell said the investigation is continuing and further charges could be pending.
The press release reminds the public that all defendants are presumed innocent until proven guilty in a court of law.
