PARKERSBURG -- A man accused of attacking a Wood County Sheriff's deputy in an incident that led to a fatal, officer-involved shooting has been indicted on a charge of malicious assault on a law enforcement officer.
Shawn Michael Bailey, 26, in custody at the North Central Regional Jail, was one of 66 people indicted this week by the Wood County Grand Jury, according to a Thursday afternoon release from Prosecutor Pat Lefebure.
According to a criminal complaint filed in Wood County Magistrate Court, Bailey struck sheriff's Lt. J.W. Allen when Allen attempted to arrest Bailey's brother, Paul M. Bailey, 21, on Oct. 17. The deputy was responding to a reported disturbance after the two men and a woman were reportedly walking along Stillwell Road in Davisville after consuming acid and alcohol.
When Allen attempted detain Paul Bailey, a fight began, with a Taser being used on the younger man. The complaint, written by a West Virginia State trooper who responded after the shooting, said Allen sustained multiple injuries to his face and bites to his arm.
The grand jury in January determined Allen's actions were justified.
Also indicted was 39-year-old Christopher L. Morgan, of 905 Elder St., Parkersburg, on a charge of negligent homicide. Morgan was the driver of a semi truck that struck a small car driven by Gregory Lyons, 65, of Parkersburg, as it pulled onto Harris Highway from Lake Washington Road on Aug. 11, 2020. Lyons died in the crash, the Wood County Sheriff's department reported.
Following the fatal shooting of Edward L. Tice II in December 2020, the accused, Thomas Burdette, was dropped of all charges after the grand jury decided he was acting in self defense to protect both himself and his family, according Lefebure. The incident occurred at JT's Auto LC at 1567 Dupont Road on Dec. 12 , Lefebure said.
