PARKERSBURG – The plaintiff in a lawsuit over the closure of Waverly Elementary School has filed a notice to dismiss the action.
Attorney Pat McFarland submitted the dismissal notice to Wood County Circuit Court on Tuesday on behalf of his client, Sharon Corbitt.
Filed at the end of June, the suit questioned the plan to consolidate Waverly into the new Williamstown-Waverly Elementary school this year in light of increased enrollment and busing when social distancing and other steps are necessary to prevent or reduce the spread of the novel coronavirus.
Wood County Circuit Judge J.D. Beane last week ordered the suit transferred to Kanawha County Circuit Court to be consolidated with another suit there. McFarland had argued the suits dealt with separate issues.
