PARKERSBURG -- On Tuesday, Wood County Circuit Court Judge Jason Wharton dismissed the indictment of Graham Elliot Godwin, who was charged with conveying false information concerning terrorist acts in March 2019.
Godwin, 28, was charged following an email sent to television station WTAP about two suspicious items found at McDonough Park in Vienna on March 24, 2019.
The two items appeared to be homemade explosives, police said. The two-liter bottle contained a liquid, nails and tinfoil, according to Vienna Police.
According to the police department, an anonymous email was sent later in the day on March 24 to WTAP about the devices at the park.
The criminal complaint in Wood County Magistrate Court from Officer C.R. Ong said the investigation found Godwin sent the email just hours after the devices were located. The email provided false information about the investigation with respect to the devices, who was responsible for placing them and a motive for placing them "in the woods," the complaint said.
Godwin was not accused of making or placing the devices at the park, Vienna Police Chief Mike Pifer previously said.
The order stated that the dismissal was requested because "the State does not wish to prosecute the case at this time."
