Wood Circuit Judge denies petition seeking to halt sanitation, recycling contracts

PARKERSBURG – A judge has denied a petition for an injunction preventing Parkersburg officials from moving forward with potential contracts for sanitation and recycling services.

The order issued by Wood County Circuit Court Judge J.D. Beane this morning says property owner Carole Hanlon’s complaint against the city is unlikely to succeed, citing the city’s powers to provide for the government, regulation and control of its affairs, including entering into contracts.

“The court will not step in and direct the municipality in the running of its day to day business unless it plainly runs afoul of Constitutional principles,” the order says.

The order also notes numerous errors in the original filing.

Hanlon had sought to have the court issue an injunction or temporary restraining order preventing Parkersburg City Council from moving forward with action on proposed contracts for solid waste removal with Waste Management and subscription-based recycling with Rumpke. The first readings of those ordinances are on the agenda for a special 7:30 p.m. council meeting today, following a 6 p.m. meeting where members of the public can ask questions about the proposals.
