No due process in laws

A few months back, I wrote a letter concerning the dangers of poorly written, overly broad “red flag laws,” which invite abuse because they have no due process written into the law.

It has been reported, the story of Stephen Nichols, a kindly 84-year-old ex-police officer and Korean War veteran who was fired from his job as a school crossing guard in Tisberry, Mass. Even worse, Nichols guns and his firearms license (which he had since 1958) were taken from him by the local police, under Massachusetts’ “red flag law.”

Nichols crime as he was overheard in a dinner worrying because the local school’s resource officer was frequently leaving his post to buy coffee and someone might take advantage of his absence to “shoot up the school.”

The local police didn’t charge Nichols as they stripped him of his Second Amendment rights. Nichols was never asked to fill out any paperwork or given receipts for his guns, or his firearms license, which he simply removed from his billfold and handed over. There was nothing resembling due process.

Due to overwhelming pushback from the Tisberry community, Nichols has been reinstated as a school crossing guard but has not had his guns or his firearms license returned.

Nichols was never arrested, charged or convicted of any crimes. The misunderstanding that led to Nichols losing his job was cleared up, but there is no process under Massachusetts law for restoring Nichols’ civil rights, that he is aware of.

In a recent interview, Nichols states he will be forced to sell his guns. If so, Nichols will be punished for the rest of his life, based on a mere misunderstanding.

This begs the questions, how many innocent people like Stephen Nichols have been stripped of their gun rights without due process by gun-hating liberal lawmakers who care nothing about saving lives, but only about depriving as many people as possible of their Second Amendment rights? Is this country any safer when we disarm good people?

Any “red flag law” without due process should and hopefully will be overturned in the courts.

If liberals truly cared about saving innocent lives, they would be working to end abortions in the U.S.
