Wood County Circuit Court

PARKERSBURG — The following cases were heard Aug. 10-11 in Wood County Circuit Court:

Before Judge J.D. Beane:

* Morgan Lefay, 42, in custody at the North Central Regional Jail in Doddridge County, entered an Alford plea to two counts of unlawful assault, lesser included offenses to the original charges of malicious assault, and one count of conspiracy to commit burglary. In an Alford plea, the defendant does not admit guilt, but acknowledges there is likely enough evidence to convict. Sentencing was scheduled for 9 a.m. Oct. 13.

Charges of burglary and conspiracy to commit malicious assault were dismissed as part of a plea agreement.

* Delbert Wesley Hall Jr., 37, a co-defendant of Lefay’s in custody at the regional jail, pleaded guilty to charges of conspiracy to commit burglary and conspiracy to commit malicious assault. Two counts of malicious assault and one of burglary were dismissed as part of a plea agreement.

Sentencing was scheduled for 9:30 a.m. Oct. 13, and Hall was released on a $5,000 personal recognizance bond.

* Beane reduced the bond of Kenny Lee Harper, 36, in custody at the regional jail, from $300,000 to $250,000. Harper, charged with second-degree sexual assault after allegedly forcing a woman to perform a sex act at knifepoint in June, had requested a bond of $50,000. He remains in custody.

* Jesse Charles Waggoner, 39, in custody at the regional jail, entered an Alford plea to a charge of wanton endangerment involving a firearm. A second count of wanton endangerment involving a firearm was dismissed as part of a plea agreement.

After a defense motion to move directly to sentencing, Beane sentenced Waggoner to up to one year in jail with credit for 147 days served and released him on time served.

* David Frederick Myers, 38, in custody at the regional jail, pleaded guilty to fraudulent use of an access device, with two other counts of the same charge dismissed as part of a plea agreement. Sentencing was delayed to accommodate substance abuse treatment in a long-term, inpatient program.

* Bryan Merritt, 38, in custody at the regional jail, pleaded guilty to a charge of fraudulent use of an access device. Four counts of fraudulent use of an access device and one charge each of fraudulent scheme and conspiracy to commit fraudulent use of an access device were dismissed as part of a plea agreement. Sentencing was scheduled for 10 a.m. Oct. 9.

* Mark Duane Powell II, 40, Parkersburg, did not appear for a status hearing. Beane revoked his bond and ordered a capias warrant issued if he did not appear by the end of the day. Powell had been charged with six counts of delivery of a controlled substance. Three were dismissed.

* Tommy Clark Leasure, 41, appeared via Skype from the regional jail and admitted to violating his probation for a charge of forgery. His probation was revoked, and Beane granted a state motion for him to complete his original one-to-10-year sentence, with credit for 106 days served.

* Beane denied a defense motion for bond of no more than $50,000 for Austin James Parker, 21, who appeared via Skype from the regional jail. He is being held without bond on a charge of aiding and abetting kidnapping.

* Christopher Allen Streight, 34, Parkersburg, pleaded guilty to receiving and transferring a stolen vehicle, and a charge of failure to appear was dismissed as part of a plea agreement. Sentencing was scheduled for 10:15 a.m. Oct. 19.
