Circuit Court

PARKERSBURG — The following cases were heard Feb. 28 in Wood County Circuit Court:

* The trial of Carl C. Burner III, 39, of Parkersburg, on a charge of making terroristic threats, was continued to 11 a.m. May 22 by Ritchie County Circuit Court Judge Tim Sweeney. Sweeney is presiding over the case, with Ritchie County Prosecutor Samuel Rogers II representing the state, because Burner is accused of making threats against Wood County personnel, including Judges J.D. Beane and Jason Wharton and Prosecutor Pat Lefebure.

* Katlin J. McMullen, 22, in custody at the North Central Regional Jail in Doddridge County, was arraigned before Wharton and entered a plea of not guilty to charges of grand larceny and conspiracy to commit grand larceny. Her trial was set for May 5. She remains in custody on a $100,000 bond.

* Mark Comuzie, 60, of Parkersburg, pleaded guilty to two counts of obtaining a controlled substance by fraud, forgery or deception. A third charge of obtaining a controlled substance by fraud, forgery or deception and one count of conspiracy to commit that offense were dismissed as part of a plea agreement. Wharton delayed Comuzie’s sentence pending his application to the drug court program.

Wood Magistrate

PARKERSBURG — Wood County Magistrate Court released the following records Feb. 28:

* A juvenile was issued a $180.25 speeding ticket.

* Brian Michael Vandergrift, 47, 1628 Ridgeway Ave., Parkersburg, was arraigned on a charge of possession of alcohol at an access site and was issued a $250 personal recognizance bond.

* Michael David Sams, 48, 602 4th Ave., Parkersburg, was arraigned on charges of a fraudulent motor vehicle inspection and driving on a suspended license and was released on a $500 personal recognizance bond.

* Austin Shane Twilley, 20, 1702 Latrobe St., Parkersburg, was arraigned on an attempted burglary charge and is being held on a $10,000 surety bond.

* Probable cause was found against Brandon Lamar Leak, 34, 4300 Brumbaugh Blvd., Dayton, for one count of manufacturing/deliver/possession with intent to deliver or manufacture a schedule I or II narcotic and his case has been bound over to Wood County Circuit Court for grand jury consideration.

* John Scott Sprouse, 44, 405 Washington Blvd., Belpre, pleaded guilty to possession of a controlled substance without a prescription and was sentenced to 90 days of home confinement.

PARKERSBURG — Wood County Magistrate Court released the following reports March 2:

* Daniel Lee Frame, 37, 413 Eighth St., Parkersburg was arraigned on a charge of robbery. Bond on the first-degree felony offense must be set in Wood County Circuit Court. According to a criminal complaint, on Jan. 31, Frame pointed a gun at another man in a room at the Economy Inn on Seventh Street in Parkersburg, struck him in the face and stole money and a cell phone from his pockets.

* Jessica Jeanette Fritts, 29, 1202 16th St., Parkersburg, was arraigned on charges of robbery and possession of a controlled substance with intent to deliver. Bond was set at $15,000 cash on the possession count. Bond will be set in Circuit Court on the robbery charge. According to a criminal complaint, Fritts lured the man Frame allegedly robbed to the Economy Inn on Jan. 31 and prevented him from leaving. She was arrested on the possession charge March 1.

* Heather Marie Koffel, 43, Belpre, was arraigned on a charge of domestic battery and released on a $500 surety bond.

* Dana Lee Kelley, 22, P.O. Box 2165, Parkersburg, was arraigned on charges of obstructing and possession of a controlled substance, methamphetamine, and released on a $1,000 surety bond.

* David Scott Hennessee, 36, 2761 Spider Ridge Road, Parkersburg, was arraigned on a charge of shoplifting, less than $500, and released on a $250 personal recognizance bond.

* Charles Purcell Bonesteel, 26, 1402 Andrew St., Parkersburg, was arraigned on a charge of possession of a controlled substance, heroin, with intent to deliver and bond was set at $1,500 cash.

* Matthew Wayne Sams, 61, 385 Willard Road, Parkersburg, was arraigned on a trespassing charge and released on a $500 personal recognizance bond.

* Kathryn Lyniece Collins, 24, 4315 Sayre Ave., Parkersburg, was arraigned on a charge of possession of a controlled substance, meth, and released on a $1,000 surety bond..

* Mark Duane Powell, 39, 2407 Beverly St., Parkersburg, was arraigned on two counts of possession of a controlled substance, meth and marijuana (less than 15 grams), and released on a $1,000 surety bond.

* Charles Ray Mackey, 38, Parkersburg, was arraigned on a charge of domestic battery and released on a $1,500 surety bond.

* Randall Andrew Beatty, 33, 3317 Third Ave., Parkersburg, was arraigned on a charge of receiving/transferring stolen goods and bond was set at $1,000 surety.

* Samantha Marie Vincent, 26, alias Samantha M. Leak, Avery Court 5B, Parkersburg, was arraigned on charges of destruction of property and shoplifting and released on a $500 surety bond.

* Ashley Nicole Forshey, 31, 713 Hillcrest St., Parkersburg, was arraigned on a charge of possession of a controlled substance, meth; possession of a firearm by a prohibited person; and maintaining a dwelling for the keeping of a controlled substance and bond was set at $1,500 cash.

* Charles Gregory Stickell, 42, Vienna, was arraigned on two counts of domestic battery and released on a $1,500 surety bond.

* Brent Allen Smith, 31 1423 National Road, Thornville, Ohio, was arraigned on charges of trespassing and public intoxication and released on a $100 personal recognizance bond.

* Herbert Eugene Myles, 30, 3771 Ashton Road, Columbus, waived a preliminary hearing on a charge of possession of a controlled substance with intent to deliver and the case was bound over to Wood County Circuit Court.

* Phillip Michael McCloy, 30, 238 Highland Lake Terrace, Washington, W.Va., had a charge of fraudulent use of an access device dismissed due to the alleged victim failing to appear.

* Matthew Paul Evanoff, 30, Parkersburg, pleaded guilty to fleeing an officer, was sentenced to 12 months jail with credit for time served and was assessed $170.25 in court costs.

* Roger Delford Smarr, 45, 823 Hugh St., Parkersburg, pleaded guilty to assault, was sentenced to time served and was assessed $170.25 in court costs.

* Erik Koffel, 33, Stockport, was arraigned on a domestic battery charge and was released on $2,000 bond.

* Gelena Faye Peggs, 38, 1386 Pleasant Ridge Road, Belleville, was arraigned on defective equipment and driving under suspension charges and was released on $1,500 bond.

* Bentley Anne Singleton, 23, 8908 Southern Highway, Rockport, pleaded guilty to speeding and was assessed $270.25 in fines and court costs.

* Tiffany Necole Huffman, 35, 941 Swann St., Apt. 1, Parkersburg, was arraigned on charges of failure to render fingerprints, battery of a police officer and two counts of obstructing and bond was set at $1,700.

* Shania LeAnn Fischer, 20, Parkersburg, pleaded guilty to obstructing and disorderly conduct, was sentenced to time served and was assessed $340.50 in fines and court costs. Fischer also pleaded guilty to shoplifting and was assessed $195.25 in fines and court costs and $259.38 in civil penalties.

* Tor Lamont Hill Jr., 27, Parkersburg, was arraigned on a domestic battery charge and was released on $1,000 bond.

* Michelle Lea Burk, 36, 2212 11th Ave., Parkersburg, was arraigned on charges of driving under suspension and no proof of insurance and was released on $1,000 bond.

* Kevin Leroy Swiger, 34, 2510 39th St., Parkersburg, was arraigned on charges of possession of a controlled substance and driving under suspension and was released on $1,000 bond.

* Jason Aaron Barone, 36, 10647 North Preston Highway, Bruceton Mills, W.Va., pleaded no contest to negligent homicide, was sentenced to 12 months home confinement and was assessed $170.25 in court costs. The original charge was DUI resulting in death stemming from an October 2019 motorcycle crash.

Wood Sheriff

PARKERSBURG  — The Wood County Sheriff’s Office released the following reports on March 2.

* The department answered 168 calls: (31) Traffic Stops; (1) Mental Hygiene Orders; (6) Unwanted Person(s); (10) Domestic Complaints and Domestic Order Services; (8) Motor Vehicle Accidents; (5) Warrant Services; (14) Area Checks; (13) Speak with Complainant by Phone/in Person; (6) Suspicious vehicles/Persons.

Feb. 28:

* Robert Parke Bender Jr., 63, of Caroline Avenue was issued a citation for leaving the scene of an accident. Both vehicles were towed and no injuries were reported.

* Matthew Wayne Sams, 61, of Willard Road was arrested on a warrant for trespassing. He was processed, arraigned and released on a PR bond.

* Roger Dale Pinkerton Jr,, 38, of 13th Street was issued a citation for driving on suspended.

* Eugene Matthew McCune, 37, Simmons Drive, Ripley, was arrested on a warrant for violation of a domestic violence protective order 2nd offense.

Feb. 29

* Deputies responded to I-77 and U.S. 50 eastbound for a two-vehicle crash with possible injuries. All were checked by EMS. One driver Joseph Alan Modesitt, 61, of Humble Heights was taken to the hospital where he was issued a citation by the deputy for failure to maintain control, failure to obey a traffic control device and DUI first-offense.

* Heather Marie Koffel, 43, of Yellow Pine Drive was arrested on a warrant for domestic battery.

* Deputies responded to Walmart on Walton Drive to assist Parkersburg Police with a shoplifter who had left the store in a vehicle with the registration to the vehicle coming back as a NCIC hit as stolen. A traffic stop was conducted on the vehicle on Mound Street. Randall Andrew Beatty Jr., 33, of Third Avenue was arrested on charges of receiving or transferring stolen property and a capias for driving revoked third-offense.

* Samantha Marie Vincent, 26, of Broadway Avenue was arrested on a warrant for destruction of property and shoplifting.

* Vance Edward Cross Jr., 39, of Staunton Avenue was arrested on a capias for trespassing, obstructing and disorderly conduct.

March 1

* Steven Mark Boise II, 34, of Elizabeth Pike was arrested on charges of driving on suspended third-offense and no insurance.

* Mark Duane Powell, 40, of Beverly Street was arrested on charges of possession of a controlled substance (meth) and possession of less than 15 grams marijuana.

* A deputy responded to Williams Highway for a vehicle accident involving a deer. The driver stated she was traveling south on Williams Highway when the deer entered the roadway and she was unable to stop and struck the deer. The deputy observed damage to the left front fender, headlight and grill. No injuries were reported and the deer could not be located.
