Davis enters plea deal in murder case
By JEFFREY SAULTON jsaulton@newsandsentinel.comPARKERSBURG - One of two men indicted in connection with the murder of a Parkersburg man in 2006 pleaded guilty Tuesday to one of the counts against him.
Nathan Wayne Davis, 23, and Justin Michael Moran, 23, both in custody at North Central Regional Jail, were indicted in a special session of the grand jury Oct. 22, 2008, on charges of murder, first-degree robbery, conspiracy to commit robbery and assault during the commission of a robbery against a person 65 years of age of older in connection with the death of Roy Matheny, 81, in 2006.
Davis signed a waiver to allow Wood County Circuit Court Judge Jeffrey Reed to inspect the presentencing report before formally accepting Davis' plea.
Davis entered a plea agreement with the state to plead guilty to first-degree robbery as charged in count two of an indictment and all other charges against him will be dismissed. He faces up to 30 years in prison on the charge.
Davis told the court Tuesday he was only involved with the robbery of Matheny. He alleged Moran killed Matheny.
Reed set accepting the plea and possible sentencing for 10 a.m. Feb. 8. As part of the agreement, Davis will testify for the state against Moran.
They were named as co-defendants in the murder of Matheny.
Moran was granted a motion to continue his case to the January court term and a new trial date was set for March 2. Moran faces life in prison for the murder charge, not less than 10 years for robbery, one to five years for conspiracy and two to 10 years in prison for the assault charge, if convicted.
A motion to severe the cases has been deferred.
Matheny, of Hawthorne Street in south Parkersburg, was reported missing Dec. 26, 2006.
According to a criminal complaint, Moran allegedly met Matheny on Dec. 26, 2006, at Grandpa's Market in south Parkersburg. Moran allegedly got into Matheny's vehicle and the pair went to a section of Staunton Avenue near Corning Park, according to the complaint.
The complaint states an altercation ensued and Matheny was stabbed. His body was found Dec. 28 in a vacant lot at the end of Staunton Avenue. His abandoned vehicle was found Dec. 27 in Park Shopping Center.
Moran was arrested June 14, 2008 as a result of information police received from the Washington County Major Crimes Task Force. Davis was taken into custody by West Virginia authorities on the same day he was released from jail in Noble County.

Life in prison should not be used here nor the death penalty. They already live like animals so life locked up will be a pleasant change for them. And death is far to easy. If it's like on tv they stav in a little room kept from the predators. I say treat them like they did Mr Matheny. No mercy they should be gang raped everyday and then cleanrd up with paint thinner.I am not saying that to sound big and bad. I truly believe that should be tortured every day till they die. Fed just enough to keep them alive,and no more.

Time to start writing our fine elected officials and take Kanawha county's lead: Reinstate the death penalty, especially in capitol crimes against the elderly and children, that would make persons such as these two fine young fellows think twice before pulling such a horrible act. Now, no matter what, they get the best of medical care as wards of the state, and we have to feed them.
