PARKERSBURG - Two pleas were heard Wednesday in Wood County Circuit Court.
Dusty Albert Davis, 22, 119 Chateau Hills, Parkersburg, entered a plea agreement to plead guilty to burglary as charged by the September grand jury. His plea included a recommendation that any sentence be suspended for entry into West Central Regional Drug Court. If he is not accepted for the program, the state will stand silent on his sentencing.
Judge J.D. Beane set sentencing for 2:30 p.m. Jan. 11 if Davis is not accepted for the drug court program. A defense motion for him to be released from home confinement was granted.
Amy Dawn Abshire, 32, No. 3 Meadowbrook Acres, Parkersburg, was set for a trial when a plea agreement was reached. In the agreement she is to plead guilty to burglary and forgery in an indictment from the January grand jury. Beane set sentencing for 9:30 a.m. Jan. 13, 2010.
Closing arguments will begin at 9:30 a.m. today in the trial of Benjamin A. Cumberledge, 31, in custody at North Central Regional Jail.
Cumberledge was indicted by the September grand jury on two counts of battery of a corrections officer and one count of child neglect creating risk of injury. Counts of burglary and entry of a dwelling were dismissed in earlier hearings.
A defense motion for a judgment of acquittal on one of the battery charges was denied.
