If she had the PIN number, then she could argue that she had PERMISSION to use the card. Not that she did, but anytime you give out your PIN to someone, you might as well just hand them your cash. Now it's a he said, she said situation. Unless she is dumb enough to admit it, it can't be proven, now can it????
