Sexual abuse suspect sentenced to prison

PARKERSBURG — A man accused of sexually abusing a minor and a family member who knew about it were sentenced to prison Monday in Wood County Circuit Court.

Clinton Edwin Diveley, 38, in custody at the North Central Regional Jail in Doddridge County, received a sentence from Judge Robert Waters of 10 to 20 years in prison on a charge of sexual abuse by a custodian. Five additional counts of sexual abuse by a custodian, two counts of first-degree sexual assault, four counts of second-degree sexual assault and three counts of child neglect resulting in injury were dismissed as part of a plea agreement.

As part of the sentence, Diveley will have to register as a sex offender for life, will be on supervised release for 50 years and is prohibited from living in a residence with minor children, according to an order from Waters.

Assistant Wood County Prosecutor Russell Skogstad said the agreement secured a felony conviction on the charge with the strongest evidence without forcing the victim to testify. He said he discussed the deal with the minor.

According to a criminal complaint, Diveley was arrested in October 2017 after Wood County Sheriff’s deputies responded to a report of a sexual assault in progress at his residence and found evidence of inappropriate contact between Diveley and a 16-year-old. When questioned by deputies, Damaris Lynn Heft, 38, of Waverly, who is related to the victim, said she did not witness that act but had witnessed inappropriate activity in the past and was aware of it.

The complaint included allegations of instances of sexual abuse over a period of multiple years. It says the victim complied because of threats and past physical abuse.

Heft pleaded guilty to four counts of child neglect creating risk of injury and was sentenced by Waters to one to five years on each charge, with the sentences to be served consecutively.

She must register on the abuse and neglect registry for 10 years following her release. A charge of sexual abuse by a parent was dismissed as part of the plea agreement.

Also on Monday in Circuit Court:

∫ Waters ordered Richard Lee Britton, 40, in custody at the regional jail, to serve up to 60 days there and be released to go directly to a drug-treatment program after finding that he had violated the terms of his probation. Britton was serving a four-year probation sentence after pleading guilty in 2016 to conspiracy to commit delivery of a controlled substance and possession of a controlled substance with intent to deliver.

∫ Waters ordered a capias warrant issued for Judd Burke, 27, of Parkersburg, after he did not report to authorities in Athens County as agreed in a Jan. 11 fugitive hearing.

∫ Judge J.D. Beane sentenced Kristie Jo Sellers, 34, of Charleston, to six years in prison, with credit for 136 days served, on a charge of conspiracy to commit delivery of a controlled substance and suspended that sentence for three years probation. The prosecution and defense had initially agreed to postpone the sentencing until Sellers completed a treatment program.

∫ The sentencing of Austin M. Adkins, 20, in custody at the regional jail, on a charge of entering without breaking was stayed, and Beane ordered him to serve six months to two years at the Anthony Center for Youthful Offenders.
