Wood circuit court hears five cases Friday

PARKERSBURG – Five hearings took place Friday in Wood County Circuit Court.

* Roger Dale Logston III, 39, 912 Virginia Ave., Parkersburg, was granted a motion by Circuit Judge Jeffrey Reed to dismiss the Oct. 31, 2011, indictment against him, ruling too much time had passed between the indictment and any trial date.

Logston’s attorney said the dismissal should be granted because Logston did not contribute to or help delay his trial and four court terms had passed since he was indicted.

* James Kelmer Laird, 51, in custody at the North Central Regional Jail, was sentenced after he pleaded guilty to charges of two counts of third-offense driving under the influence, for which he was sentenced to one to three years in prison, one count of second-offense DUI, for which he was sentenced to one year in the regional jail with 235 days credit, and one count of battery, for which he was sentenced to one year in jail with credit for 23 days served.

Reed set the battery and second-offense DUI cases to be served concurrently and consecutively to the counts for third-offense DUI.

* Melody Fox, 35, 90 Pine St., Washington, W.Va., pleaded guilty to conspiracy to commit grand larceny. Circuit Judge Robert Waters set sentencing for 9 a.m. May 13. A motion for probation or alternative sentencing was taken under advisement.

* Christopher Lee Nelson, 38, in custody at the North Central Regional Jail, admitted to the allegation in the petition to revoke his home confinement. Circuit Judge J.D. Beane granted a motion to return Nelson to home confinement with the condition he go to the day report center for substance abuse treatment. Nelson pleaded guilty Jan. 3, 2013, to a charge of aiding in concealing stolen property. Charges of breaking and entering, grand larceny and receiving stolen property were dismissed.

* Lucas Adam Shank, 32, 301 Sixth Ave., Parkersburg, admitted to the allegation in the petition to revoke his home confinement. Beane granted a motion to return to home confinement with the condition he enroll in a substance abuse program. Shank was placed on home confinement on Dec. 3, 2012, after he pleaded guilty to a charge of third-offense DUI.
